In an effort to increase uniform and secure accessibility of medical records and communication between patients and providers, Greater Baltimore Medical Center, Inc. ("GBMC") is pleased to extend MyChart at GBMC (herein "MYCHART") MyChart at GBMC Bedside (herein "MYCHART BEDSIDE") to its patients. MYCHART is an internet application that allows patients to review their medical record, receive certain laboratory and imaging results, communicate with their GBMC healthcare providers on non-urgent matters and arrange for clinical services/appointments. The electronic format of MYCHART presents unique security and privacy issues, necessitating user responsibility. As such, to request a MYCHART account, you must read and accept the Following Terms and Conditions, which includes legal and privacy waivers, disclaimers and terms personal responsibility.
If you are an admitted patient using the MYCHART BEDSIDE application from your own tablet or a hospital owned tablet, the following terms and conditions also apply to you. MYCHART BEDSIDE is a temporary account that is offered to qualified hospitalized patients at GBMC. Both the use of the tablet to access your account and the account itself are free of charge to you as the patient. Once you are discharged from the hospital, all of your personal health data, and any other data that was stored in your MYCHART BEDSIDE account will be cleared from the device you were using during your admission, even if you were using your own personal device, in accordance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA). From your MYCHART BEDSIDE account, you will be able to see upcoming scheduled procedures and medications, who will be taking care of you for the day, and select lab results. You will also be able to access patient educational materials and make NON-URGENT requests from a list of items. Before your discharge, you will be given the opportunity to sign up for your permanent MYCHART account, which you can access from your own computer at home.
BY ACCESSING OR USING MYCHART OR MYCHART BEDSIDE, YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MAY NOT ACCESS OR USE MYCHART OR MYCHART BEDSIDE AND MUST IMMEDIATELY EXIT THE SITE. ALL TERMS AND CONDITIONS LISTED BELOW APPLY TO BOTH MYCHART AND MYCHART BEDSIDE.
1. Incomplete Medical Record. The portion of your medical record available on MYCHART may not be your entire medical record. The scope of what is provided in your MYCHART is at the discretion of your GBMC providers. THEREFORE, YOU ACKNOWLEDGE THAT MYCHART SHALL NOT BE USED TO MAKE HEALTHCARE DECISIONS OR DIAGNOSIS AND GBMC SHALL NOT BE LIABLE FOR ANY PERSONAL INJURY, INCLUDING, BUT NOT LIMITED TO, DEATH, ARISING FROM YOUR USE OR MISUSE OF MYCHART OR ANY INFORMTION OR CONTENT THEREIN. The sole method for obtaining a complete copy of your medical record shall be by contacting the offices of your healthcare providers directly, by phone or through a scheduled office visit.
2.Use Not Required and Discretionary Access. You are not required to use MYCHART and may discontinue use at any time. You are not being charged for your use and GBMC may terminate your access at any time, with or without cause, without providing notice. You do not have a contractual or legal right to MYCHART access and improper activities, such as abusive language and abuse of scheduling or canceling appointments, may result in suspension or termination of your use of MYCHART.
3.Duty to Check In-box and Email Notifications. Your providers will communicate with you through MYCHART regarding important healthcare information. It is your duty to monitor your inbox regularly and your personal email for message notifications. You will be notified via the e-mail address you provide when you register your MYCHART account when there is new information to review, including but not limited to provider messages, letters, test results, prescriptions renewals, after visit summaries, appointment status and reminders and questionnaires. You agree to hold GBMC and its affiliates harmless for any loss, injury or claims resulting from your failure to see or read your email notifications or MYCHART information and messages in a timely manner. If you do not receive a response message from your provider, for reason of spam, technical glitches or human error, it is your responsibility to follow-up with your provider.
4.Privacy Concerns. When you send a message through MYCHART, your communication will be routed to an individual within your healthcare provider's department. Consequently, individuals other than your provider may review your medical information as required to address your question, concern or request. If you have information you want shared only with your provider, you should contact your provider directly and not communicate through MYCHART. Similarly, when you receive an email notification from MYCHART, it will not contain direct private medical information, but a message that certain types of new medical information are available may in and of itself contain information that you do not want others who have access to your email, either on purpose or by accident, to know. You should take these privacy concerns into account when deciding to use MYCHART and providing access, intentionally or unintentionally, to your personal email. By accepting these Terms and Conditions and using this site, you agree to receive email notification and communications from your providers. Messages exchanged between you and your healthcare provider become part of your official medical record and you should use appropriate discretion accordingly. This information is confidential but may be released with your consent or by legal requirement.
5.Security Considerations and Personal Use Only. MYCHART is intended for your use only (unless by proxy as described in Section 8 below). GBMC shall use increased security measures, such as activation codes, in the setting up of your MYCHART. Once you have activated your account with a user name and password of your choosing, the security of your account and your login information is your responsibility. You are responsible for the consequences of your communications regarding MYCHART and the unauthorized accessed information from your MYCHART. Your password and username may be changed as needed through your MYCHART. Access to MYCHART is only intended to be for personal use. If you would like to download any part of the content for any other reason than personal use you must receive written permission from GBMC.
6.Non-Emergency Matters Only. MYCHART is not the appropriate channel for urgent matters as it may take providers several days to respond to requests and other communication. You should contact your provider directly for a quick response and dial 911 for emergencies.
7.Minors. Individuals must be 13 years of age or older to activate a MYCHART account. Between the ages of 13-17, parents and guardians may access their child's chart pursuant to the requirements in Section 8 below, Proxy Access. Certain information may not be viewed by a parent or guardian without the consent of a minor pursuant to State and Federal law, and as such, certain information will not be available for through the MYCHART medical records for minors. Proxy access will terminate automatically on an individual's 18th birthday.
8.Proxy Access/Request by Someone other than the Patient to Access MYCHART.
A)Individuals Requesting Proxy Access. Individuals, 18 years of age or older, may request proxy access to another individual's MYCHART if he or she has parental or legal guardianship rights. Individuals requesting proxy access will be required to demonstrate their legal right to the medical information. Except in the case of parents who both have legal custody, only one individual will be granted proxy if the requirements are met. If the proxy's relationship changes with the patient, it is his or her legal duty to immediately inform GBMC via the MYCHART at 443-849-6001 or your physician's practice. GBMC reserves the right to revoke proxy access at any time for any reason. The process for requesting proxy access is to complete a Request for Access to Child's MYCHART Account form or Request to Access to MYCHART Account by Legal Representative form, along with the appropriate legal documentation, at the provider's office.
B) Patients Authorizing Other User Access. You, as the patient, may authorize other users to view your medical records by completing and submitting the appropriate MYCHART Authorization for Release of Health Information form while at your provider's office.
9.Waiver of Liability and No Warranties. GBMC shall not be liable for any damages, including but not limited to incidental, special, indirect, direct or consequential damages, loss of profits, interruption of business, or related expenses which may arise from your use of or inability to use MYCHART, whether or not GBMC has advised of the possibility of such damages, including but not limited to damages related to software and access system hardware defects, internet service, and loss of or inaccuracy of data, and regardless of whether the claim is based in contract, tort or any other legal theory.
GBMC EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES CONCERNING MYCHART, AND PROVIDES MYCHART ONLY ON AN "AS IA" AND "AS AVAILABLE" BASIS, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, TITLE, NON-INFRINGEMENT, FITNESS FOR A PARTICULAR PURPOSE, PERFORMANCE, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
GBMC MAKES NO GUARANTEES REGARDING MYCHART AVAILABILITY, INCLUDING THE AVAILABILITY OF INFORMATION, AND OCCURRENCE OF DOWNTIME, SERVICE INTERRUPTIONS, INTENTIONAL OR INADVERTENT INTRUSTIONS, VIRUSES OR WORMS OR OTHER MECHANISMS THAT MAY ATTACK YOUR COMPUTER. YOU ARE SOLELY RESPONSIBLE FOR ENSURING THAT YOUR COMPUTER HAS ADEQUATE PROTECTIONS AGAINST ANY OF THE FOREGOING. IN ADDITION, YOU ACKNOWLEDGE THAT YOUR INFOMRATION WILL BE TRANSMITTED OVER THE INTERNET AND THAT THERE IS NO GUARANTEE OF ACCURACY OR SECURITY. YOU MAY CONTINUE CONTACT YOUR PROVIDER DIRECTLY AT ANYTIME, REGARDLESS OF WHETHER MYCHART IS AVAILABLE.
THE MARYLAND UNIFORM COMPUTER INFORMATION ACT ("MUCITA") SHALL NOT APPLY TO THIS AGREEMENT AND TO THE EXTENT THAT IT IS APPLICABLE, THE PARTIES HERETO AGREE TO OPT OUT OF MUCITA PURSUANT TO SECTION 22-104 OF THE COMMERCIAL LAW ARTICLE OF THE ANNOTATED CODE OF MARYLAND.
10.Governing Law. This Agreement of Terms and Conditions shall be governed by Maryland law, without giving effect to any choice of law rules. You agree to jurisdiction in Baltimore County.
11.Amendments and Revisions to the Terms and Conditions. GBMC reserves the right to change, revise and update the information and content provided on this website, including theses Terms and Conditions, without providing you notice. You should read these terms periodically to make sure there have not been changes. Your continued use of the website signifies your continued acceptance of these Terms and Conditions and all changes thereto, regardless of your knowledge and notice of said changes.
